“The Supreme Court’s 2009 decision in Ricci v. DeStefano found that the city did not have substantial ground on which to throw out the results of a 2003 firefighter promotion test merely because white test-takers outperformed minorities by a considerable margin.
After the Ricci decision came out, the city gave out the promotions mandated by the test, as well as millions in settlements to the plaintiffs and their attorney.
Now the city seems to be in double jeopardy: Michael Briscoe, an African American firefighter in New Haven, is suing the city for validating the results of that very same test – as per the Supreme Court’s ruling – and denying him a promotion. Briscoe claims he would have achieved the necessary test results had the exam been 30 percent written and 70 percent oral, whereas the 60-40 split favored the white firefighters who got promoted.“
